Does Jesus Teach Against The Death Penalty? shows through Scripture from the Bible that God's Word--including the New Testament--sanctions capital punishment for adults who commit crimes of violence such as first degree murder, rape, and other acts of violence worthy of death. NOTE: We said crimes of violence, NOT sins. While crimes of violence are sins, they are unlike the sins of immorality and defiance against God (adultery, fornication, idolatry, etc.), which carried the death penalty ONLY under the Old Testament.
This article focuses exclusively on the question of whether the elderly who have committed crimes worthy of death, according to the Bible, should ever receive the death penalty. In the case of the elderly, the crimes were usually committed during their youth.
Does biblical Scripture instruct us to consider their age and feebleness in deciding whether to execute them? The fact is, we find no such instructions in the Word of God. So, if we refrain from executing them simply because they have grown old, we are doing nothing less than showing favor because of their age, and / or the physical state that age has brought upon them. On this, the Bible is not silent.
Old and New Testament Scripture let us know in no uncertain terms that we are not to show favoratism of any sort when we pass judgment. One of the many Scriptures that tell us this is 2 Chronicles 19:5-7, which reads: "And he set judges in the land throughout... And said to the judges, Take heed what ye do, for ye judge not for man, but for the Lord, who is with you in the judgment. Wherefore now let the fear of the Lord be upon you. Take heed and do it, for there is no iniquity with the Lord our God, nor respect of persons..."
The above passage not only tells us not to have respect of persons when we judge, it also tells us to fear, if we do. Why? Because God is behind judgment that is carried out according to His instructions, and He does not have respect of persons. When it comes to judgment, whether for reward or for punishment, the Lord does not favor the rich, nor pity the poor (Lev. 19:15, Ex. 23:3). Women who committed sins and crimes worthy of death were to be executed just as men (Lev. 20:10). God's Law was to be applied to all the children of Israel as well as to all foreigners among them. (Lev. 24:22) The list of passages that clearly speak against having respect of persons in all its forms could go on to include New Testament passages as well, including Acts 10:34, which reads, "Then Peter opened his mouth, and said, Of a truth I perceive that God is no respecter of persons".
Conclusion: The ninety-year-old who commits--or committed when he or she was younger--crimes worthy of death is not to be sparred the death penalty while the thirty-year-old is executed for his or her crimes worthy of death. Remember, we are talking about crimes worthy of death in God's eyes, not man's.
